ALBANY – A person familiar with the probe said Tuesday that New York State officials are investigating health claims and other marketing by makers of energy drinks.
The person said subpoenas were issued this summer to 5-Hour Energy, AMP and Monster Beverage Corp. by State Attorney General Eric T. Schneiderman. Speaking on condition of anonymity because the case hasn't yet been made public, the person confirmed the reports of subpoenas divulged to investors in financial filings by 5-Hour Energy and Monster.
Michael F. Jacobson of the Center for Science in the Public Interest said Tuesday that the industry is rightly under scrutiny for health claims and the threat to young consumers of the energy drinks.
Company officials and Schneiderman declined to comment
